Political Funds Act Violation Case, Full Acquittal at First Instance
Despite a guilty verdict already having been handed down in a preceding case, we contested both procedural illegality and the merits, securing a full acquittal.
Basic Facts
The client was indicted on charges of delivering money to election officials during an internal party primary process, and of receiving political funds through an outside organization.
A related preceding case had already resulted in a guilty verdict, and the court was already familiar with the details of the case.
The same prosecutors who had led the investigation appeared at trial to maintain the prosecution.
How Jeongpyeong Helped
Retained at the first-instance trial stage, we first structured the massive case record. We filed requests to inspect and copy not only the evidentiary records submitted by the prosecution but also the underlying investigative records, securing a full picture of the case.
Noting that the key witness recalled events from a year earlier in detail but claimed not to remember a meeting with the prosecution just a month prior, we uncovered the circumstances of that prior meeting through a fact-inquiry request to the detention center.
By reviewing the video recording of the voluntary submission process for the mobile phone submitted as evidence, we pointed out in court how the witness's statements had reversed completely between daytime and nighttime on the same day.
Anticipating that procedural illegality alone might not be enough to determine the outcome, we also proved innocence on the merits.
Result
The court found the client not guilty on all charges.
This case was decided by a strategy that contested both procedural illegality and the substantive truth together.
